Brandeis School of Law at University of Louisville and has been licensed to practice law since 1990. She has extensive experience in workers’ compensation, civil litigation, and subrogation.
In accordance with the General Assembly’s 2018 Amendments to KRS Chapter 342, the DWC is in the process of implementing Treatment Guidelines based upon the Official Disability Guidelines (“ODG”), which provide comprehensive integrated evidence-based medical treatment and return-to-work guidelines. Preliminary Regulations have been issued by the DWC to implement the Treatment Guidelines. The Treatment Guidelines take effect January 1, 2020. The new Workers’ Compensation Pharmaceutical Formulary mandated by the General Assembly’s 2018 Amendments to KRS Chapter 342 is now in effect and the DWC is issuing final Regulations implementing the formulary. The new Pharmaceutical Formulary applies July 1, 2019 to all injuries or dates of last exposure after January 1, 2019, and for any claims with date of injury or date of last exposure prior to January 1, 2019 if the prescription is not a refill of the drug already prescribed. For dates of injury and last exposure before January 1, 2019, the formulary does not apply to refills of medications previously prescribed until January 1, 2020.
